Definitions <\/h3>\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions of Sale are intended to define the rights and obligations of the parties in connection with the rental of canoes and kayaks by the Rental Company to any person legally capable of entering into a contract (hereinafter referred to as the \u201cClient(s)\u201d), whether acting as a consumer or as a professional within the meaning of the French Consumer Code.<\/p>\n\n<h3 class=\"wp-block-heading\">Article 1.2. Purpose <\/h3>\n\n<p class=\"wp-block-paragraph\">Client: any natural person or legal entity entering into a contract with the Rental Company under these General Terms and Conditions of Sale. The Client must be over 18 years of age and legally capable of entering into a contract.<br\/>Group: any party of ten people or more covered by a single booking made by one representative.<br\/>Participant: any person taking part in the service, even if they have not directly entered into a contract with the Rental Company.<br\/>Service: canoe and kayak rental including equipment and related services. <\/p>\n\n<h2 class=\"wp-block-heading\">Article 2 \u2013 Content and Scope of Application<\/h2>\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions of Sale shall automatically apply to all services sold or offered for sale by the Rental Company. They apply to all sales made through any distribution or marketing channel.<br\/>Any order or purchase implies the Client\u2019s unconditional acceptance of these General Terms and Conditions of Sale, which shall prevail over any other conditions, except those expressly accepted by the Rental Company and stated in the signed booking contract\/quotation.<br\/>The Client acknowledges having read and accepted these General Terms and Conditions of Sale prior to making a reservation and concluding the signed contract\/quotation. <\/p>\n\n<h2 class=\"wp-block-heading\">Article 3 \u2013 Pre-Contractual Information<\/h2>\n\n<p class=\"wp-block-paragraph\">The Client acknowledges having been provided, prior to placing an order and\/or concluding the signed contract\/quotation, in a clear and comprehensible manner, with these General and Special Terms and Conditions of Sale, as well as with all the information listed in Article L. 221-5 of the French Consumer Code, where the Client is acting as a consumer.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 4 \u2013 Prices<\/h2>\n\n<h3 class=\"wp-block-heading\">Article 4.1. Final Price and Additional Taxes <\/h3>\n\n<p class=\"wp-block-paragraph\">The rental price is stated in euros, inclusive of all taxes (VAT included), per person (or according to the specifications of the offer provided). For groups, the price may be stated as a package rate. It may also be calculated according to the number of participants.<br\/>The price includes the items specified in the signed quotation\/contract.<br\/>Unless otherwise stated in the description of the Service and in the contract\/quotation, the price does not include transportation to the Service location, accommodation and stay expenses, meals and drinks, expenses payable on site, or any service or provision not expressly mentioned in the description of the Service.  <\/p>\n\n<h3 class=\"wp-block-heading\">Article 4.2. Payment Terms <\/h3>\n\n<p class=\"wp-block-paragraph\">The Client may use several payment methods: credit\/debit card, bank transfer, holiday vouchers, bank cheques, or cash.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 5 \u2013 Rental Equipment<\/h2>\n\n<p class=\"wp-block-paragraph\">The rental equipment (hereinafter referred to as the \u201cEquipment\u201d) includes the items specified in the description of the services.<br\/>For day trips, the Equipment includes: one canoe or kayak, one single or double paddle per person, one personal flotation device (PFD) per person, and one storage container per boat, for which waterproofing is not guaranteed.<br\/>For multi-day trips, the following may be added to the above list: one container per person, one dry bag, one padlock, a river navigation map, as well as optional camping equipment (tent, foam mattress, cooking kit, gas stove, table lamp, and storage trunk).<\/p>\n\n<h2 class=\"wp-block-heading\">Article 6 \u2013 Security Deposit<\/h2>\n\n<p class=\"wp-block-paragraph\">The Rental Company may require a security deposit at the time of booking, the amount of which is specified in the quotation and in the service description.<\/p>\n\n<p class=\"wp-block-paragraph\"><br\/> <br\/>This security deposit may be retained in whole or in part in the event of damage to the Equipment while it was under the Client\u2019s responsibility (without prejudice to the Rental Company\u2019s right to claim additional compensation corresponding to the total amount of the actual damage incurred).<\/p>\n\n<h2 class=\"wp-block-heading\">Article 7 \u2013 Use of the Rental Equipment<\/h2>\n\n<p class=\"wp-block-paragraph\">The booking confirmation transfers responsibility for the rented Equipment to the Client for the entire duration of the rental period. The rental period begins when the Equipment is handed over by the Rental Company and ends when the Equipment is returned by the Client to the Rental Company in accordance with the contract.<br\/>The Client undertakes to take proper care of the rented Equipment and to return it in the same condition as when it was provided by the Rental Company.<br\/>In the event of damage to the Equipment, the Client agrees to reimburse the full cost of the damage. For information purposes, the replacement value of the rented Equipment is as follows:  <\/p>\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Old Town type canoe &gt; \u20ac1,500<\/td><td>Single paddle &gt; \u20ac20<\/td><\/tr><tr><td>RTM type canoe &gt; \u20ac800<\/td><td>Double paddle &gt; \u20ac30<\/td><\/tr><tr><td>Kayak &gt; \u20ac500<\/td><td>Camping tent &gt; \u20ac50<\/td><\/tr><tr><td>Personal flotation device (PFD) &gt; \u20ac50<\/td><td>Camping cookware kit &gt; \u20ac50<\/td><\/tr><tr><td>Storage container &gt; \u20ac30<\/td><td>Camping stove &gt; \u20ac30<\/td><\/tr><\/tbody><\/table><\/figure>\n\n<h2 class=\"wp-block-heading\">Article 8 \u2013 Obligations<\/h2>\n\n<h3 class=\"wp-block-heading\">Article 8.1. Obligations of the Rental Company <\/h3>\n\n<p class=\"wp-block-paragraph\">In accordance with applicable regulations, the Rental Company complies with navigation restrictions on the Dordogne River. For the section between Cazoul\u00e8s and the municipality of Alles-sur-Dordogne, the Rental Company may cancel any service if the water level measured at the C\u00e9nac bridge gauge station is equal to or higher than 1.50 metres for unsupervised navigation.<br\/>Depending on the maximum authorised flow rates, the Rental Company may also cancel any service if the river water level is too high:<br\/>Section between Argentat-sur-Dordogne and Puybrun &gt; : max. 90 m\u00b3\/s<br\/>Section between Puybrun and Cazoul\u00e8s &gt; : max. 150 m\u00b3\/s<br\/>Section between Cazoul\u00e8s and Limeuil &gt; : max. 240 m\u00b3\/s     <\/p>\n\n<h3 class=\"wp-block-heading\">Article 8.2. Obligations of the Client <\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>The Client undertakes, on their own behalf and on behalf of all participants they represent:<\/strong><br\/>not to navigate with a child under 5 years of age. <br\/>to ensure that each participant is able to swim at least 25 metres and is capable of submerging themselves underwater.<br\/>to ensure that children aged 5 to 12 are accompanied and supervised by an adult at all times.<br\/>to ensure that each participant wears a personal flotation device (PFD) and closed-toe shoes throughout the entire navigation period.<br\/>to return all rented Equipment covered by this service to the Rental Company in its original condition.<br\/>to hold valid personal civil liability insurance on the date of the service.<br\/>not to have any physical or psychological condition preventing participation in the activity.<br\/>not to wear boots, abandon any nautical equipment or litter along the route, or enter private properties bordering the route unless expressly authorised.<br\/>to ensure that all participants grant image rights authorisation in accordance with the following article.<br\/>and more generally, to comply with the safety and navigation instructions set out in Article 8 and provided on site by the Rental Company or its staff.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 9 \u2013 Image Rights Waiver<\/h2>\n\n<p class=\"wp-block-paragraph\">The Rental Company may take photographs or videos in which the Client may appear. By accepting these General Terms and Conditions of Sale, the Client unreservedly authorises the Rental Company to capture and use photographs and other images featuring the Client taken during the performance of the Service. <\/p>\n\n<h2 class=\"wp-block-heading\">Article 10 \u2013 Bookings<\/h2>\n\n<p class=\"wp-block-paragraph\">Online sales: the Client selects the desired services and adds them to their basket. The Client then confirms the booking request, accepts these General Terms and Conditions of Sale, and proceeds with online payment. The Client will receive a confirmation email.<br\/>Counter sales: the Client visits the Rental Company\u2019s premises and indicates the services they wish to purchase. The Client reads and accepts these General Terms and Conditions of Sale before proceeding with payment.<br\/>Distance sales: the Client may book remotely by email or telephone.<br\/>By email: the Client informs the Rental Company of the desired services, and the Rental Company sends a detailed quotation together with these General Terms and Conditions of Sale. After reading and accepting these General Terms and Conditions of Sale, the Client returns the signed quotation by email or post, together with the deposit or full payment for the service, as applicable. The Rental Company sends a booking confirmation email once payment has been received and cleared.<br\/>By telephone: the Client books the services by phone and then proceeds with payment at the counter.<br\/>In the case of a Group booking, the final number of participants must be communicated to the Rental Company no later than 7 days before the start of the Service.     <\/p>\n\n<h2 class=\"wp-block-heading\">Article 11 \u2013 No Right of Withdrawal<\/h2>\n\n<p class=\"wp-block-paragraph\">The Rental Company invokes this absence of the right of withdrawal and states that, for all services falling within the scope of Articles L.221-28 or L.221-2 of the French Consumer Code, the Client shall not benefit from any right of withdrawal.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 12 \u2013 Safety<\/h2>\n\n<p class=\"wp-block-paragraph\">The Client accepts and undertakes to comply, on their own behalf and on behalf of all participants included in the booking, with the Safety Charter.<br\/>Minors under the age of 18 who are not accompanied by an adult (legal guardian) are not permitted to rent Equipment. They remain under the responsibility of their parents or legal guardians, who certify that they are able to swim at least 25 metres and submerge themselves underwater.<br\/>Canoeing is open to everyone from the age of 5, provided that the child is able to swim at least 25 metres, submerge themselves underwater, and feels comfortable in the water.<br\/>The Rental Company is unable to verify the participants\u2019 level of sporting ability or their physical or medical condition. The Client undertakes to ensure that all participants are fit and capable of taking part in the Service.<br\/>Participants undertake that they are not subject to any medical contraindication preventing them from taking part in the Service. The Services are not recommended for pregnant women. If a participant does not have a medical contraindication but depends on special medical care or treatment, or if their state of health requires particular attention, they must bring any appropriate emergency medication in accordance with medical recommendations and consult their doctor beforehand.    <br\/>The Client who made the booking shall be solely responsible and undertakes to ensure that all participants forming the crew possess the physical and mental abilities required for canoeing and kayaking.<br\/>The Client and all participants undertake to comply with the safety and navigation instructions provided by the Rental Company\u2019s staff during the safety briefing before the start of the Service.<br\/>The Client and all participants also undertake not to take part in the Services while under the influence of alcohol, drugs, or any other substance likely to impair their judgment.<br\/>The Rental Company reserves the right to refuse any person who fails to comply with the instructions and whose behaviour may endanger their own safety or that of others. Such refusal shall not give rise to any refund.<br\/>The Rental Company also reserves the right to exclude, during the Service, any participant whose behaviour is likely to disrupt the proper conduct of the activity or compromise the safety or peace of mind of other participants. In such cases, the Client or participant shall not be entitled to any refund or compensation.  <\/p>\n\n<h2 class=\"wp-block-heading\">Article 13 \u2013 Liability<\/h2>\n\n<p class=\"wp-block-paragraph\">The Rental Company holds Professional Civil Liability Insurance covering the services sold.<br\/>Each participant must be covered by civil liability insurance and, preferably, personal accident insurance with the insurer of their choice for the practice of white-water sports.<br\/>In the case of a rental not supervised by an instructor, the Client undertakes to ensure that all participants possess sufficient knowledge and technical skills to practise this sporting activity. In such cases, the Client and participants take part entirely at their own responsibility and risk, and the Rental Company shall not be held liable.<br\/>The Client acknowledges being aware of the risks inherent in the activity, including remoteness, isolation, and the specific nature of aquatic environments.<br\/>The Rental Company shall not be held liable for the loss, theft (including from vehicles), or damage to personal belongings (such as glasses, mobile phones, cameras, identity documents, etc.) that participants may bring with them during the Service and which may occur during the activity.<br\/>Mobile phones, cameras, and any equipment or belongings sensitive to water must be protected by suitable waterproof cases provided by the participant. The Rental Company does not guarantee the waterproofness of storage containers and cannot be held liable if the contents of a container are damaged by water.<br\/>In the event of theft or damage to loaned equipment, the participant\/Client may be required to pay compensation for wear and tear or reimburse the full replacement value of the equipment.  <\/p>\n\n<h2 class=\"wp-block-heading\">Article 14 \u2013 Modification of the Contract<\/h2>\n\n<p class=\"wp-block-paragraph\">Any Service that is shortened, not fully used due to the Client\u2019s actions, or started late due to the Client shall not give rise to any refund.<br\/>The Rental Company is bound only by the services sold to the Client. Any modification must be expressly accepted in writing by the Rental Company. Such modifications may be subject to additional charges, which shall be communicated to the Client before implementation.<br\/>In the case of a Group booking, if the Group arrives with fewer participants than the number confirmed at the time of participant confirmation, the full price initially agreed for the Group shall remain applicable. If the Group arrives with more participants than planned, the Rental Company reserves the right to accept or refuse the additional participants. If the Clients refuse to reduce the size of the Group to the number agreed upon at the time of participant confirmation, the Rental Company may refuse to perform the Service and the contract shall be terminated at the sole fault of the Client, without any refund being made, and the full price shall remain payable.    <\/p>\n\n<h2 class=\"wp-block-heading\">Article 15 \u2013 Termination of the Contract<\/h2>\n\n<h3 class=\"wp-block-heading\">Article 15.1. Termination of the Contract by the Client <\/h3>\n\n<p class=\"wp-block-paragraph\">The Client may terminate the contract at any time before the start of the Service. For such termination to be valid, the Client must notify the Rental Company by email or by post. <br\/>In such cases, the Rental Company shall charge the Client cancellation fees and may retain all or part of the deposit or balance already paid, according to the following schedule:<br\/>Cancellation 30 days before the Service: 100% refund.<br\/>Cancellation 15 days before the Service: 80% refund.<br\/>Cancellation 7 days before the Service: 50% refund.<br\/>Cancellation 48 hours before the Service: 20% refund.<br\/>Cancellation less than 48 hours before the Service: no refund.<br\/>In the case of a Group booking, the cancellation by one or more members shall not give rise to any refund once the final number of participants has been confirmed.<br\/>However, where the Client\u2019s cancellation results from a force majeure event, no cancellation fees shall be payable.<br\/>The cancellation date shall be the date on which the Rental Company receives the Client\u2019s cancellation request.<\/p>\n\n<h3 class=\"wp-block-heading\">Article 15.2. Termination of the Contract by the Rental Company <\/h3>\n\n<p class=\"wp-block-paragraph\">The Rental Company may terminate the contract at any time before the start of the Service. In such cases, the Client shall be offered either a rescheduling of the Service or a credit voucher. If the Client refuses, a refund shall be issued.  <br\/>The Client shall not be entitled to any additional compensation where the cancellation results from the impossibility of carrying out the Service under optimal safety conditions (for example, adverse weather conditions) or in the event of force majeure.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 16 \u2013 Protection of Personal Data<\/h2>\n\n<p class=\"wp-block-paragraph\">The data collected is used for the purpose of managing contracts and customer follow-up during the rental period.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 17 \u2013 Insurance<\/h2>\n\n<p class=\"wp-block-paragraph\">The Rental Company holds professional civil liability insurance covering its activities.<br\/>The Client undertakes to hold valid and up-to-date civil liability insurance covering any damage they may cause.<\/p>\n\n<h2 class=\"wp-block-heading\">Article 18 \u2013 Dispute Resolution<\/h2>\n\n<h3 class=\"wp-block-heading\">Article 18.1. Applicable Law <\/h3>\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions are governed by French law. However, the application of French law shall not deprive a consumer Client of the mandatory provisions of the law of their country of residence. <\/p>\n\n<h3 class=\"wp-block-heading\">Article 18.2. Mediation <\/h3>\n\n<p class=\"wp-block-paragraph\">In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the Rental Company has implemented a consumer mediation scheme.<br\/>The appointed mediation body is: SAS CNPM M\u00c9DIATION-CONSOMMATION.<br\/>In the event of a dispute, the consumer may submit a complaint via the following website:<br\/>http:\/\/cnpm-mediation-consommation.eu<br\/>or by post to:<br\/>CNPM \u2013 M\u00c9DIATION \u2013 CONSOMMATION<br\/>27 Avenue de la Lib\u00e9ration<br\/>42200 SAINT-CHAMOND<br\/>France<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Article 1 \u2013 Preamble Article 1.1.
